Acceptation and Modification of The Conditions of Use

Use of the website (hereinafter the “Site”) of the Association de la construction du Québec (ACQ) implies acceptance of the terms and conditions indicated below.

The ACQ reserves the right, at any time, to amend, alter or update the conditions of use of this Site. These additions, amendments and updates take effect as soon as they are posted on the Site. It is therefore advisable to refer regularly to the Site.

Site Modifications

The ACQ reserves the right to terminate, suspend or modify this Site, in whole or in part, at any time, without notice and without liability.

Personal Use

The Site is made available to Internet users exclusively for their personal, non-commercial use.

You are responsible for keeping your access code confidential. Do not disclose this code to anyone, because the related privileges belong solely to you.

Member Directory

The member directory may be used only for legitimate reasons and for personal, non-commercial use or internal use by the entity on behalf of which the Internet user is acting, to the exclusion of any other commercial exploitation of the directory’s content. Downloading and printing copies of the member directory, or parts of it, is permitted only when necessary for these purposes. Any other use of the information contained in the member directory is strictly prohibited. Users may not (except as noted above) publish, transmit, distribute, post, modify or create works derived from all or part of the member directory, nor may they sell or participate in the sale of all or part of the directory or exploit all or part of the directory in any way.

Service Description

The Site offers information to users who wish to obtain information about the construction industry in Québec, in particular as regards training, market development, new practices, health and safety, technological innovation, sustainable construction and lobbying activities with government authorities and other Québec or Canadian economic players. The Site also offers standard template documents to its members.

Policy on The Protection of Intellectual Property Rights

The information contained on the Site is the property of the ACQ, which holds the intellectual property rights to it. Unless otherwise noted, the ACQ’s rights apply to all documents, data, compilations and other works distributed there. The trademarks are also protected.

Restricted licence

The ACQ grants users a restricted licence allowing them, without authorization or fees but on condition of mentioning the source, to display on their computer and to print, download and use the underlying HTML language, texts, video clips, Web capsules and other content to which they have access on the Site solely for non-commercial, personal or educational purposes, provided:

  1. They do not modify the content;
  2. They include with each copy of the content and display on it the corresponding copyright notice and this restricted licence.

No other use is permitted.

As regards use for marketing purposes, prior authorization must be obtained from the ACQ. See in this connection the Intellectual Property Rights section.

Integrity of Information

The ACQ guarantees the integrity of the information at the specific time that it appears on the Site but not subsequently. It does not guarantee any documents, data or other content once they have been modified in any way, whether or not after downloading. In addition, in case of any discrepancy between an official text and the Site’s content, the official text shall prevail.

The ACQ makes every effort to ensure that the information available on its Site is accurate, complete and up-to-date. However, it must remind users that the official texts of laws and regulations as well as other official documents take precedence.

Intellectual property rights

Intellectual property rights are exclusive rights held by the ACQ to the documents it produces or publishes, whether these documents are administrative or official texts and whether they are produced by its employees, a government department, a public body or a third party that has assigned its rights or granted a licence for use. These rights include, among others, copyright, trademarks and patents.

For example, the data and information compilations contained on the Site are works protected by copyright in the same way as multimedia, literary, musical or artistic works.

The use by a third party of items covered by such rights, unless indicated otherwise or due to exceptions contained in the relevant laws, is subject to authorizations, licences, permissions or concessions of interest by the right holder. This applies in particular to the reproduction, storage or placing in a memory for purposes other than those strictly permitted.

Anyone who seeks or desires, for marketing purposes, to produce, store, download, translate or publicly present any sounds or images or to convey by telecommunication any document, data or other content from the Site must obtain prior authorization from the ACQ. This authorization may be obtained by contacting the ACQ’s Legal and Government Affairs department.

Furthermore, in using these works, in the broader sense, nobody may remove the name of the rights holder or modify the content through addition, deletion or otherwise, without infringing on moral rights.

Notice of intellectual property

The ACQ holds intellectual property rights to the Site’s graphic and visual identity as well as to the texts, video clips, Web capsules and other content to which users have access on the Site, or has obtained authorization from the intellectual property holder of this content before using it on the Site.

Trademarks

“ACQ”, “ACQ Résidentiel”, “ModuleC”, “Mutuelles de prévention ACQ”, the warranty seals “Garantie ACQ”, “Mutuelle de formation ACQ” and “ACQconstruire” are ACQ trademarks. The names of other products and services appearing on the Site are trademarks of their respective owners. The display of trademarks or trade names on this Site does not transfer or create licences or other rights with respect to these trademarks or trade names. Any unauthorized use of them is strictly prohibited.

Links to other websites

The Site includes links to other websites. Insofar as the ACQ does not control these sites, it cannot guarantee the accuracy or completeness of the content, advertising, products, services or any other material available on these sites or based on them. Moreover, the ACQ cannot be held responsible for any proven or alleged damage or loss arising from or connected to the use of or trust in the content or the goods or services available on these external sites.

Regarding the Site

Information on the Site may sometimes come from governments, ministries, organizations or other outside sources. The ACQ has made every effort to ensure the accuracy, timeliness and reliability of the Site’s content. Sections of the Site are reviewed regularly. However, some recent changes may not be found on the Site. If this occurs, please notify the ACQ.

Limitation and exclusion of liability

The Site may contain inaccuracies or typographical errors. In no case may the ACQ be held liable for damages of any kind, including actual, indirect or consequential damages resulting from the use or relevance of information available on the Site or related to it.

No guarantee

The ACQ does not guarantee the quality, accuracy or completeness of any information on the Site. This information is provided “as is” with no guarantee or condition.

No recommendation

No information, material or content regarding a third party’s products or services, mentioned or included on the Site or in any link to or from the Site, constitutes a recommendation of these products or services.

The information provided on the Site does not constitute legal advice. The Site content is only intended to provide general information and observations.
